G - Right of withdrawal
1. Pursuant to art. 5 of Legislative Decree No. 185/1999, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity, or does not make the purchase by indicating a VAT number in the order form to MPC Srl), he/she has the right to withdraw from the purchase contract for any reason within 14 days of delivery of the product without any penalty, except as indicated in point 3.
2. To exercise this right, the customer must send a request in the "POST-SALES" area
3. The right of withdrawal is in any case subject to the following mandatory conditions:
a. the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, attached software, etc.);
b. the right does not apply to sealed food, audiovisual products or computer software (including those attached to hardware material), once opened. In particular for products that require assembly (installed garden shower fans or assembled fireplaces) or any other used product.
c. the purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend, when possible, placing it in a second box, on which to affix the RMA number (return authorization code) issued by MPC Srl; in all cases, the affixing of labels or adhesive tape directly on the original packaging of the product must be avoided;
d. the item subject to the exercise of the right of withdrawal must bear the same serial number present on the MPC Srl sales invoice; if the item were to bear a serial number different from that indicated on the invoice, the return will not be accepted and the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
e. shipping costs for returning the goods are the responsibility of the customer;
f. shipping, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
g. in the event of damage to the goods during transport, MPC Srl will notify the customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the goods (if insured); in this eventuality, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
h. MPC Srl is not liable in any way for damage or theft/loss of goods returned with uninsured shipments;
4. The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in the cases ascertained
4.1)Even partial use of the goods and any consumable materials
4.2) The lack of the external packaging and/or the original internal packaging;
4.3)The absence of integral elements of the product (accessories, cables, manuals, parts,...);
4.4) Damage to the product for reasons other than its transport
4.5) Customers who purchase with a VAT number cannot exercise the right of withdrawal
4.6) Personalized products or made-to-measure products (see artistic, tailoring, furnishing products, etc.)
5. Without prejudice to any repair costs for damage found to the original packaging, MPC Srl will refund the customer the full amount already paid, within 14 days of the return of the goods, by reversing the amount charged to the credit card or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (ABI code - CAB - Current Account - IBAN of the invoice holder).
6. MPC srl is not responsible for agreements between Customers and Suppliers or Manufacturers in the case of particular rights of withdrawal. It warns Customers that the products must strictly follow the management procedure and return to the agreed warehouse.
H- Cancellation or Refusal.
The Customer may request the cancellation of a purchase order if, at the time of the cancellation request, the order is still being prepared and has not been delivered to the warehouse for shipping.
If at the time of the cancellation request the product has already been entrusted to the courier, the Customer must collect the product and subsequently exercise the right of withdrawal. In the event of refusal of the product or failure to collect it at the time of delivery due to second thoughts or other reasons, the Customer will be charged for the costs of returning the product, administrative and logistics costs and storage at the courier in the event of order storage.
I - Guarantees
1. All products marketed by MPC Srl are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to Legislative Decree no. 24/02. To benefit from warranty assistance, the Customer must keep the invoice (or DDT) that he will receive together with the purchased goods.
2. The manufacturer's conventional warranty is provided in accordance with the procedures illustrated in the documentation included in the product packaging. If, following intervention by an Authorized Assistance Center, the defect is found not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and repair requested by the Authorized Assistance, as well as transport costs, if incurred by MPC Srl.
3. The 24-month warranty pursuant to Legislative Decree no. 24/02 applies to the product that presents a lack of conformity, provided that the same is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This warranty, in compliance with Legislative Decree no. 24/92, is reserved only for the private Consumer (a natural person who purchases the goods for purposes not related to his/her professional activity, or makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, MPC Srl will, at no cost to the Customer, restore the conformity of the product by repair/replacement or by reducing the price, up to the termination of the contract. If, following intervention by an Authorized Assistance Center, a lack of conformity does not result in a lack of conformity pursuant to Legislative Decree no. 24/02, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as transport costs if incurred by MPC Srl.
4. Replacements in the event of DOA (Dead On Arrival: product not working when first turned on), without prejudice to the existence of the conditions for the application of Legislative Decree no. 24/02, will be carried out only if expressly provided for by the manufacturer. The times for replacement or possible repair of the product depend exclusively on those indicated by the manufacturer.
5. In the event that, for any reason, MPC Srl is unable to replace a product under warranty (repaired or replaced), it may proceed, with the customer's consent, to replace the product itself (if still in the price list) or with another of equal characteristics and value or, finally, to issue a discount voucher of the same amount to be spent on another product valid for 6 months from the time of issue.
6. No damages can be requested from MPC Srl for any delays in carrying out repairs or replacements of products under warranty.
7. In cases where the application of the guarantees requires the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend, when possible, to insert it in a second box; in all cases, the affixing of labels or adhesive tape directly on the original packaging of the product should be avoided.
8. The Customer informs MPC Srl for the management of the product under warranty by inserting the practice in the POST-SALES area. The competent Office will respond with an email sending an Authorization Number. Within 7 working days from sending the RMA form the goods must return to the MPC Srl warehouse for verification and control.
